You Had Right of Way but Ended Up Hurt in a Missouri Motorcycle Crash

You narrowly escaped serious injury and possibly death. You should be happy, but instead, you’re angry and hurt. It doesn’t seem fair that you ended up in the hospital while the driver who caused your accident walks away free of injury.

Sadly, that is often the case in Missouri motorcycle accidents. Since a motorcyclist has no protection from the impact of a crash, the rider can end up severely injured in what might otherwise be classified as a “moderate” car accident.

When that happens, don’t let the other driver excuse his or her careless actions. If you had right of way when the accident occurred, you deserve to be compensated for your injuries. The other driver may try to get out of his or her responsibility by using one of these arguments:

  • “I couldn’t see you.”
Don’t let the other driver use the excuse that you were in his car’s blind spot. Even if that were the case, it’s the other driver’s responsibility to check those blind spots before turning into another lane.
  • “I thought I had enough time.”
A driver who tried to turn left in front of a motorcycle likely misjudged how far the rider was. This is a frequent problem because drivers assume that the motorcycle is farther away, forgetting that it’s simply a smaller vehicle.
  • “I didn’t know what you were doing.
Motorcyclists often use hand gestures to signal their intent. These are universal signals that every driver should know and understand.

If you’ve been injured in a Missouri motorcycle accident where you had the right of way, don’t let the other driver try to rob you of the compensation you desperately need.
